Henry VIII Powers in the One Canadian Economy Act:
Limits on Federal Regulatory Powers and Section 35 Aboriginal Rights

Event Overview

This meeting is hosted by the Constitutional/Civil Liberties Section of the Canadian Bar Association and the International Commission of Jurists - Canada (ICJ Canada), in partnership with the University of Ottawa Professional Development Institute (uOttawa PDI).

Paul Daly, Ruben Tillman, and Karine Millaire, address the constitutional limits of exceptional cabinet powers to circumvent regulatory processes and s.35 rights of Aboriginal Peoples in Canada’s One Canadian Economy Act, formerly Bill C-5. The future of many national projects proposed by the federal government and the relevant provinces implementing them have C-5 Henry VIII clauses at their core. This has the potential to affect the wide range of indigenous treaty's and aboriginal rights. Papers from this event will be published in the National Journal of Constitutional Law.

This event may qualify for lawyers' professional development hours (1.5 hours).
